One of the biggest mistakes landlords make is treating a tenant simply as a customer.

A tenancy is a contractual partnership built on mutual responsibilities. The landlord provides a safe, well-maintained property, while the tenant is responsible for paying rent on time, respecting the lease agreement and taking proper care of the apartment.

Step One: Professional Tenant Verification

Choosing the right tenant begins with a professional verification process.

At Legal.IN, we use SimpleRent, a specialised tenant verification platform that allows us to perform several important checks before any lease agreement is signed.

Identity Verification

The applicant verifies their identity either through secure online banking or by using an official identity document.

The system automatically validates the tenant’s PESEL and identity information, providing confidence that the applicant is genuine.

Income Verification

Financial stability is equally important.

We always verify whether the future tenant has a stable and legal source of income. While no verification process can eliminate every possible risk, confirming official employment or documented business income significantly reduces the likelihood of future payment problems.

Debt Verification

Another essential step is checking whether the applicant has outstanding financial obligations.

Using the available verification systems in Poland, we review whether the tenant appears in debt registers or has unresolved financial liabilities.

This additional layer of screening helps minimise the risk of renting to someone who is already experiencing serious financial difficulties.

A Proper Lease Agreement Is Just as Important as Choosing the Right Tenant

Even an excellent tenant cannot replace a professionally prepared lease agreement.

Many landlords simply download a generic template from the internet, replace the names and rental amount, and assume they are fully protected. Unfortunately, every property, every landlord and every tenancy is different.

For rentals between two private individuals, an Occasional Lease (Umowa Najmu Okazjonalnego) together with a notarial declaration may provide additional protection. However, in practice, disputes may still require lengthy court proceedings.

When a property is rented by a company to a private individual, we strongly recommend an Institutional Lease (Umowa Najmu Instytucjonalnego).

In addition, we arrange a notarial declaration (oświadczenie o poddaniu się egzekucji), which considerably simplifies the legal enforcement process if the tenant fails to fulfil their contractual obligations.

Where appropriate, additional legal documentation may also be prepared to facilitate the recovery of compensation for damage caused to furniture, appliances or other elements of the property.

Professional Management Does Not End on Move-In Day

Finding the right tenant is only the beginning.

We believe that the first months of the tenancy establish the standards for the entire rental relationship.

For this reason, expectations are communicated clearly from day one. If the lease agreement states that rent is due by the 10th of each month, that deadline is treated as a contractual obligation—not a suggestion.

Whenever payments are delayed or other lease conditions are breached, we address the issue immediately. Small exceptions often become major problems when they are ignored.

By consistently enforcing the agreed terms from the very beginning, we create a professional relationship based on responsibility, transparency and mutual respect.
